INTRODUCTION

These terms and conditions (the “Terms”) between you (an “End User” or “user” and, in the aggregate, “End Users” or “users”) and FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE (“we,” “us,”,and “our”), govern your use of (the “Site”), (the “familyscapegoathealing Substack Site”), (“our Substack site”) and form the basis of an end user license agreement and privacy policy (“EULA”) between you, an End User, and us. By using the Services, you accept these terms and conditions in full, including those in our Privacy Policy. If you disagree with these terms and conditions, in part or in whole, you must not use the Services.

FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE currently hosts its free subscriber FSA-related articles and paid subscriber FSA Education Community content and features with the third-party provider Substack Inc. Each End User is therefore encouraged to read said third-party’s (Substack’s) separately binding Terms of Use and Privacy Policy. To the extent that these Terms or our Privacy Policy conflicts with any third-party Terms of Use or Privacy Policy in a way that affects End Users’ relationship with us, these Terms shall constitute the prevailing Terms governing said relationship.

ELIGIBILITY

These Terms set forth the legally binding terms and conditions that govern your use of the Services.  By opening, accessing or using the Services in any way, you are accepting these Terms (on behalf of yourself or the entity that you represent), and you represent and warrant that you have the right, authority, and capacity to enter into these Terms (on behalf of yourself or the entity that you represent).  You may use the Services only if you can form a binding contract with FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE and only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations. You may not access or use the Services or accept the Terms if you are not at least 18 years old.  If you are not 18 years old and/or you do not agree with all of the provisions of these Terms, do not access and/or use the Services. The Services are not available to any End Users previously removed from the Services by FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE.

Please note that these terms require the use of arbitration (Section 6.0) on an individual basis to resolve disputes, rather than jury trials or class actions, and also limit the remedies available to you in the event of a dispute.

1.              Accounts

1.1            Account Creation.  In order to use and/or receive certain features and/or aspects of the Services, you (or someone at your place of business on your behalf) must sign up and/or register for an account (“Account”) and provide certain information about yourself as prompted by the signup and/or account registration form. 

If your monthly or annual subscription renewal payment initially fails, Stripe will attempt to complete the charge up to four times over a one week period to fulfill your subscription order unless you cancel your subscription.

Accounts permanently deleted by Stripe for known or unknown reasons (including suspected fraudulent activity) will also be deleted by FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE to protect our Substack account and site from possible suspicious activity. Alternatively, based on our sole discretion, we may attempt to notify you via email that your Stripe account has been deleted and your paid subscription order could not be fulfilled.

Expiring Credit Card: Stripe will attempt to email you to notify you when your credit card on file is about to expire.

1.2 Pausing paid subscriptions

Pausing content creation allows FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE to take a break from content creation when needed. When your subscription is paused, the billing cycles for your subscription will be frozen. New readers will not be able to pay, and existing subscribers won't be charged. FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE can stay on pause for as long as is needed. When publishing again resumes, the billing cycles of our Substack site subscribers will resume.

1.3 Refund Policy. You may cancel your Substack account and subscription to FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE at any time – however, there are no pro-rated refunds for cancellation (although we may choose to offer users this at our discretion). Payments are nonrefundable and there are no refunds or credits for partially used billing periods. In the event that we must suspend or terminate your account for violating our Terms of Service, you understand and agree that you shall receive no refund or exchange for any unused time on a subscription, any license or subscription fees for any portion of the Services, or any content or data associated with your account. In addition, if this publication is shut down for reasons beyond my control, such as Substack being unable to provide services or due to my becoming incapacitated or in the event of my death, refunds in such an unfortunate situation will not be possible.

At any time, and for any reason, we may provide a refund, partial refund, or discount to some or all of our subscribers. The amount and form of such refunds and the decision to provide them are at our sole and absolute discretion and does not obligate us to provide such refunds in the future under any circumstance.

1.4 Cancelling Free or Paid Subscriptions

At any time, and for any reason, we may remove your comments and/or your ability to comment and/or terminate your Substack subscription (including paid subscriptions) with our Substack Site (familyscapegoathealing) and/or ban you from our site if this is deemed necessary to protect the health and well-being of our Substack community.

When you cancel your paid subscription, you lose access to all paid content, past and present.

Refer to 5.4(a) for more information regarding why a user may be terminated and/or banned from our Substack.

1.5  Account Responsibilities.  You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. 

2.    Access to and Use of the Services Your access to the use of the FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE Substack site depends on Substack and their Server administration. We cannot control if the Substack site ‘goes down’ and/or is inoperable or off-line and we are not responsible for refunding you for times you could not access the site. We will do all we can to work with Substack on your behalf to notify them of subscribers’ inability to access Substack and our Substack site if we are notified of such but cannot guarantee an outcome will be generated that resolves your issue to your satisfaction.

2.1            License.  

Unless otherwise stated, FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE owns the intellectual property rights in our Substack site. We do NOT own or claim copyright to user comments (including user chat and discussion thread comments). Subject to the license herein, all intellectual property rights are reserved only content created by FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE.

2.2            Certain Restrictions.  The rights granted to you in these Terms are subject to the following restrictions: (a) you shall not license, sub-license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Services, whether in whole or in part, or any content displayed in or on the Services; (b) you shall not republish, reproduce, redistribute, modify, edit, make derivative works of, disassemble, reverse compile, reverse engineer, or show in public any part of the Services; (c) you shall not access the Services in order to build a similar or competitive website, newsletter, Substack site, product, or service; and (d) except as expressly stated herein, no part of the Services may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means.  Unless otherwise indicated, any future release, update, or other addition to functionality of the Services shall be subject to these Terms.  All copyright and other proprietary notices on the Services (or on any content displayed on the Services) must be retained on all copies thereof.

2.3            Modification.  FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE reserves the right, at any time, to modify, suspend, or discontinue the Services (in whole or in part) with or without notice to you.  You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Services or any part thereof whether in total or solely with respect to your Account and/or usage. In the event that you have paid for the Services and there is a modification, suspension or discontinuation of the Services at any time and for any reason, you understand and agree that we will be under no obligation whatsoever to refund you any payment, in part or in whole, and you may not recuperate any said payment from us. We may, at our discretion, issue refunds in specific circumstances, such as the termination of our Substack or the paid subscriber feature, or a special situation presented to us by the subscriber that warrants a partial or full refund.

2.4            No Support or Maintenance.  You acknowledge and agree that FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE have no obligation to provide you with any support or maintenance in connection with the Substack services. You may contact Substack customer support directly for any support services needed by emailing them at support@substack.com.

2.5            Ownership.  Excluding any User Content that you may provide (defined above in section 2.1), you acknowledge that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Services and its content are owned by FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE or our suppliers.  Neither these Terms (nor your access to the Services) transfers to you or any third party any rights, title or interest in or to such intellectual property rights, except for the limited access rights expressly set forth in Section 2.1. FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE and its suppliers reserve all rights not granted in these Terms.  There are no implied licenses granted under these Terms.

2.6  Subscriber Privacy Limitations. As of the date hereof, the FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE generally publishes new content (both free and paid) two to four times a week. All of my public articles are visible to all subscribers and the general public. There are exceptions to the above content release schedule but, in each case, both our Substack site and the its content is clearly marked in ways that delineate whether a particular Website article/entry is (i) open to the public or, alternatively, (ii) paywalled content reserved for paying subscriber only.

You may not use a group or corporate inbox to subscribe to our Substack site nor may you share or “forward” content from our Substack designated, marketed, distributed, or otherwise clearly denoted as a “paid,” “member” or “paid subscriber” product (or any other moniker that clearly demonstrates that said content has been paid for) beyond the limits provided in Permitted Subscriber Sharing below.

Similarly, you may not use a group or corporate email address to subscribe to and access Members’-only content on the Website and you may not share access to paywalled content on the Website.

Discounted Group Subscriptions: If more than one person in your company/organization wants regular paying subscriber-only all-access to our Substack site, we offers volume pricing (15% off) for multiple subscriptions.

FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE reserves the right to terminate any or all of these exceptions at any time globally or on an individual user basis. Unauthorized sharing of paid subscriber content is subject to our cancelling your subscription at our sole discretion without notice, explanation or, if applicable, refund.

Non-enforcement of any of the foregoing shall not be construed as a waiver of any and all applicable rights set forth in these Terms.

2.8        Non-Permitted Substack Account Information Sharing. You may not share your user ID and/or password with anyone at any time so they may access our free or paid content. Unauthorized access to our Substack site is subject to FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE our terminating your subscription with our Substack site at our sole discretion without notice, explanation or, if applicable, refund.

2.9        Payment Disputes. End Users understand and agree that Substack uses a third-party payment provider (Stripe) to handle/manage all payments and that, as such, FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE has limited control over said third-parties’ ability to timely process any dispute issues or refund requests.

In the event of a payment dispute, End Users shall submit in writing by email to fsaeducation@proton.me the basis of said dispute and any and all amounts disputed prior to filing a dispute with Substack or the credit card processor Stripe so that we have an opportunity to help you settle the matter efficiently and quickly. In the absence of a disagreement over said dispute in which case other provisions of these Terms may apply, End Users understand that we will work with any and all third-parties to effectuate a speedy resolution to the dispute but can make no guarantees or assurances regarding the timeliness of resolution.

3.            Acceptable Use

           FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE does not actively moderate or review Subscriber comments, chats, threads, etc. You may report comments using Substack’s ‘report’ feature (or by writing fsaeducation@proton.me), which we will review and address in the manner that ensures the welfare of the Community is maintained. If you report many comments that are clearly appropriate for the Community your account may be terminated as a result.

 You must not use our Substack site in any way that causes, or may cause, damage to the Services or impairment of the availability or accessibility of the Services; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. You acknowledge that all content provided by FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE is for informational and educational purposes only and is not meant to represent diagnostic, medical, or mental health solutions nor legal advice - whether from us or from others you engage with via the paid Community features offered - and shall not be construed as such.

4. Data Collection: You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction or data harvesting) on or in relation to our Substack site.

            You must not use the Substack site for any purposes related to marketing without FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE’s express written consent.

5.         User Content

5.1            User Content.  “User Content” means any and all information and content (including, without limitation, text, images, audio material, video material, audio-visual material) that an End User submits by email or otherwise connected to, or uses with, the Services (e.g., without limitation, content in the End User’s profile, comments, feedback, Discussion or Chat threads, events, or other materials submitted by you, regardless of whether you authored such materials).  You are solely responsible for your User Content.  You assume all risks associated with use of your User Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your User Content that personally identifies you or any third party.  You hereby represent and warrant that your User Content does not violate our Acceptable Use Policy below. You may not represent or imply to others that your User Content is in any way provided, sponsored or endorsed by FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE.  Because you alone are responsible for your User Content, you may expose yourself to liability from us or other subscribers if, for example, your User Content violates the Acceptable Use Policy. We are not obligated to backup any User Content, and your User Content may be deleted at any time without prior notice.  You are solely responsible for creating and maintaining your own backup copies of your User Content if you desire. 

5.2            License.  You hereby grant (and you represent and warrant that you have the right to grant) to FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE an irrevocable, nonexclusive, royalty-free and fully paid, worldwide license to display your User Content on our Substack site. You hereby irrevocably waive (and agree to cause to be waived) any claims and assertions of moral rights or attribution with respect to your User Content. You understand that your comments and other Community contributions via Chat and Discussion threads can be seen by other subscribers. We do include information at the top of our content indicating if the content is available to all subscribers or can only be seen by paid subscribers but depend on Substack to ensure this information is properly displayed.

5.3        Other Limitations on User Content.

Your User Content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE or a third party (in each case under any applicable law).

You must not submit any User Content to the Website that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE reserves the right to edit or remove any material submitted to the Website or hosted or published upon the Website.

Notwithstanding FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE rights under these terms and conditions in relation to User Content, we do not undertake to monitor the submission of such content to, or the publication of such content on, the Website.

By posting any User Content on our Substack site, you expressly grant, and you represent and warrant that you have all rights necessary to grant to FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE a royalty-free, sub-licensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to your User Content, including your name, voice, and/or likeness as contained in your User Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Substack site and any other product now existing or later developed by Substack in relation to FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. 5.4           Acceptable Use Policy for User Content.  The following terms constitute our User Content “Acceptable Use Policy”:

MANDEVILLE does not actively moderate or review Subscriber comments, chats, threads, etc. You may report comments using Substack’s ‘report’ feature (or by writing fsaeducationservices@proton.me), which we will review and address in the manner that ensures the welfare of the Community is maintained. If you report many comments that are clearly appropriate for the Community your account may be terminated as a result.

(b) PRIVACY: Some content that is free to all subscribers may be publicly visible to non-subscribers and may be picked up by search engines. Comments are therefore primarily (but not always) restricted to paid subscribers, which keeps them ‘hidden’ from all but paying subscribers. Posts that are visible to ‘everyone’ will be clearly marked as ‘Public’. NOTE: Your comments may at times appear under another paid subscriber’s ‘likes’ if they have turned this feature on in their Substack account settings (we do ask paid subscribers to turn this feature off when they subscribe).

You are responsible for your comments and any consequences that result from said comments. It is recommended that identifying details and personal information not be shared in comments. MANDEVILLE is not responsible for any issues resulting in privacy violations caused by any changes, failures, ‘bugs’, or ‘glitches’ in Substack’s software or user interface.

By using the Substack service, you agree not to use the Services to collect, upload, transmit, display, or distribute any User Content (i) that violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (ii) that is unlawful, harassing, abusive, tortious, threatening, harmful, invasive of another’s privacy, vulgar, defamatory, false, intentionally misleading, trade libelous, pornographic, obscene, patently offensive, promotes racism, bigotry, hatred, incorporates verbal abuse, or physical harm of any kind toward self (such as threatening suicide) or against any group or individual or is otherwise objectionable; is violent or threatening or promotes violence or actions that are threatening to any other person; (iii) that is harmful to minors in any way; or (iv) that is in violation of any law (including state and federal securities laws governing, among other things, laws relating to material non-public information), regulation, or obligations or restrictions imposed by any third party.

(c)            In addition, you agree not to: (i) upload, transmit, or distribute to or through the Services any computer viruses, worms, or any software intended to damage or alter a computer system or data; (ii) send through the Services unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (iii) use the Services to harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent; (iv) interfere with, disrupt, or create an undue burden on servers or networks connected to the Services, or violate the regulations, policies or procedures of such networks; (v) attempt to gain unauthorized access to the Services (or to other computer systems or networks connected to or used together with the Services), whether through password mining or any other means; (vi) harass or interfere with any other user’s use and enjoyment of the Services; or (vi) use software or automated agents or scripts to produce multiple accounts on the Services, or to generate automated searches, requests, or queries to (or to strip, scrape, or mine data from) the Services (provided, however, that we conditionally grant to the operators of public search engines revocable permission to use spiders to copy materials from the Services for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials, subject to the parameters set forth in the Substack robots.txt file).

5.5            Enforcement.  We reserve the right (but have no obligation) to review any User Content, and to investigate and/or take appropriate action against you in our sole discretion if you violate the Acceptable Use Policy or any other provision of these Terms or otherwise create liability for us or any other person. Such action may include removing or modifying your User Content, removing your ability to add comments (even if you are a paid subscriber), terminating your Account in accordance with these Terms, and/or reporting you to law enforcement authorities.

5.8.              Privacy Policy. We respect the information that you provide to us, and want to be sure you fully understand exactly how we use that information.  So, please review our privacy policy (the “Privacy Policy”), which explains everything and forms a part of these Terms.

5.9.              Indemnification.   You agree to indemnify and hold FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE harmless, including costs and attorneys’ fees, from any claim or demand due to or arising out of (a) your use of the Services, (b) your violation of these Terms, (c) your violation of applicable laws or regulations, (d) your Feedback, or (e) your User Content, including Surveys, Comments, Replies, Chat content, or comments in Discussion threads. You alone are responsible for your comments and actions on our Substack. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.  You agree not to settle any matter without the prior written consent of FAMILY SCAPEGOATING ABUSE (FSA) EDUCATION | REBECCA C. MANDEVILLE.  We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

6.0 Disputes / Arbitration

Dispute Resolution: If a dispute arises from or relates to this Agreement, the parties agree to attempt to resolve it through direct discussions. If that doesn’t work, the parties agree to mediation administered by the American Arbitration Association under its Commercial Mediation Procedures. If mediation is unsuccessful, the parties agree to binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The parties agree that claims will be heard by a single arbitrator and shall be held via Zoom or similar online conferencing platform. If dispute must be arbitrated outside of the US, the parties agree to have the arbitration through the International Centre for Dispute Resolution (ICDR).
